Supreme Court gets new chief justice

Justice Barbara Madsen has been elected by the members of the Supreme Court to serve as its chief justice.  Justice Madsen takes over the post as out-going chief justice, Gerry Alexander, steps down from the administrative role in January.  The LRC supported Justice Madsen in her 2004 campaign, based largely on her good scores on the LRC Judicial Scorecard.  In the latest installment, Justice Madsen received a score of 63 percent, which put her in second place on the court.  Justice Madsen faces re-election in 2010, along with Justices Jim Johnson and Richard Sanders. 

Homeowners on the hook for swine flu?
Yes, it’s possible.

Homeowners and businesses should brace themselves for lawsuits arising from the swine flu, so says defense trial lawyer Charles Kutner in an interview published last week

As hypothetical examples of the kind of legal action the illness could create, Mr. Kutner suggested that a suit could arise if a guest contracted flu after attending a cocktail party where the host did not warn that their child had the illness.

Similarly, a homeowner could be at risk of becoming a defendant if they failed to vaccinate their child against flu and the youngster passed on that illness to children invited for a play date--one of whom sickens and dies.

“The exposure is there [and] you’ve got a lawsuit on your hands,” he warned.

Last month, the LRC unveiled the latest installment of its “Tracking the Trial Lawyers” report.  The analysis reveals that the ten trial lawyer Political Action Committees (PACs) continue to pour significant money into campaign coffers along with $7 million spent by individual lawyers.  The report leaves little doubt that lawyers are among the dominate—if not the most dominate—special interest group in Olympia.  For a hard copy of the report, please contact the LRC
